1. Who We Are and What the Platform Does
1.1 Platform operator.
Limo All Over Ltd (“Limo All Over,” “we,” “us,” or “our”) operates a technology marketplace, website, customer application, driver application, booking tools, communications tools, and payment interface (collectively, the “Platform”).
1.2 Independent transportation providers.
Transportation is accepted and performed by an independent limousine company (“Provider”) under the Provider’s legal name, licenses, operating authority, vehicles, drivers, and insurance. Limo All Over does not own or operate the Provider’s vehicles and does not employ the Provider’s drivers. Providers are not authorized to bind Limo All Over.
1.3 Our responsibility.
We remain responsible for operating our Platform and for our own payment-processing, booking-transmission, and customer-support obligations. Nothing in these Terms excludes a right or remedy that applicable law does not permit us to exclude.
2. Eligibility, Accounts, and Authority
2.1 Age.
You must be at least 18 years old and legally capable of entering into a contract to create an account or book a trip. A parent or legal guardian must arrange transportation involving an unaccompanied minor, if accepted by the Provider.
2.2 Accurate information.
You must provide current and accurate contact, passenger, pickup, destination, flight, payment, and accessibility information and keep your account secure. You are responsible for activity conducted through your account unless you promptly report unauthorized access.
2.3 Booking for another person.
If you book for another passenger, you confirm that you are authorized to do so, have provided these Terms and the Privacy Policy to that passenger, and may provide the passenger’s information for the trip.
3. Booking and Confirmation
3.1 Request and acceptance.
A booking request is not final until the Platform issues a confirmation. A Provider may accept or decline a request based on availability, service area, vehicle requirements, legal restrictions, or safety considerations.
3.2 Provider and vehicle assignment.
The confirmed Provider may use a qualified substitute driver or an equal or higher vehicle class. A lower vehicle class requires your approval or an appropriate price adjustment. Provider identity and available driver/vehicle details will be shown in the Platform when assigned.
3.3 Changes.
Changes to time, route, pickup, destination, passengers, stops, luggage, accessibility needs, or vehicle class are subject to availability and may change the price. We will request your approval before a material additional charge not already disclosed or reasonably resulting from a change you requested.
4. Prices, Booking Fee, and Payment
4.1 Price disclosure.
The checkout page will display the transportation fare, taxes or mandatory charges, the separate Limo All Over booking fee when applicable, and the total before you authorize payment.
4.2 Platform-generated bookings.
A $3.00 Limo All Over booking fee is added to bookings generated through Limo All Over’s public marketplace. The fee is charged on top of the transportation fare and is non-refundable when the customer cancels, including a timely cancellation.
4.3 Provider-originated bookings.
The $3.00 Limo All Over booking fee does not apply when a Provider uses the Platform to manage a booking for its own independently sourced customer, unless the checkout page clearly states otherwise before payment.
4.4 Payment processor.
Payments are processed through Stripe and its financial partners. You authorize the disclosed amount to be charged to your selected payment method and agree to the payment processor’s applicable terms. Limo All Over does not store your complete payment-card number.
4.5 Adjustments.
You authorize charges you approve for requested changes, additional stops, additional waiting, tolls, parking, damage, cleaning, or similar items when disclosed at booking, approved by you, or supported by reasonable documentation and permitted by law. You may dispute an incorrect charge by contacting us.
5. Cancellations, Refunds, Waiting, and No-Shows
5.1 Incorporated policy.
The Cancellation and Refund Policy forms part of these Terms. The cutoff is measured using the scheduled pickup time in the pickup location’s local time.
- Cancellation at least 6 hours before pickup: the transportation fare is refundable, but the $3.00 booking fee is not refundable.
- Cancellation less than 6 hours before pickup: 100% of the transportation fare is charged, and the booking fee remains non-refundable.
- No-show: 100% of the transportation fare is charged, and the booking fee remains non-refundable.
- Free waiting: 15 minutes for a standard pickup and 60 minutes for an airport pickup, subject to the airport provisions below.
- Provider cancellation, Provider no-show, or confirmed Platform error preventing the trip: the transportation fare and booking fee are refunded in full, unless you accept a replacement service.
5.2 Airport pickups.
When you provide a correct flight number, the Platform and Provider may use flight information to adjust for a documented delay. The 60-minute waiting period ordinarily begins at the flight’s recorded arrival time. If no usable flight number is provided, the confirmed pickup time controls. Cancellations, diversions, customs delays, terminal changes, and extraordinary events may require direct coordination and will be handled reasonably based on the circumstances.
6. Location, Communications, and Trip Safety
6.1 Customer location during a trip.
If you grant location permission, the customer application may collect and share your precise location only during an active trip—from trip start until completion—to support pickup coordination, estimated arrival information, live trip progress, safety, support, fraud prevention, and dispute review. Tracking stops when the trip ends or is canceled. Location may continue while the application is in the background during the active trip, as disclosed by the device. Refusing location permission may disable live-location features but does not prevent a booking based on the entered pickup address.
6.2 Driver location.
The Provider’s driver application may transmit a driver’s location while the driver is Online/Available, traveling to a pickup, or performing a trip. Customers may see limited trip-relevant driver location information; they do not receive the driver’s full location history.
6.3 Communications.
You consent to transactional emails and trip-related SMS messages necessary to administer a booking. Message and data rates may apply. Reply STOP to stop SMS messages and HELP for help; stopping messages may limit trip updates. Marketing emails are optional and include an unsubscribe method. We will not send marketing text messages without any separate consent required by law.
7. Passenger Responsibilities and Conduct
- Be ready at the confirmed location and time, keep your telephone available, and verify the assigned vehicle and driver before entering.
- Provide accurate passenger, luggage, child-seat, pet, service-animal, accessibility, and special-assistance requirements before confirmation.
- Comply with law and reasonable safety instructions; do not threaten, harass, damage property, smoke where prohibited, carry illegal items, or create an unsafe condition.
- A Provider may refuse or end service for unlawful or unsafe conduct. Documented cleaning or damage costs may be charged to the responsible customer to the extent permitted by law.
- Service animals will be accommodated as required by applicable law. Other animals are subject to advance Provider approval.
8. Delays and Events Outside Reasonable Control
8.1 Travel conditions.
Estimated arrival and trip times are not guarantees. Traffic, weather, road closures, flight changes, government action, mechanical problems, communications failures, emergencies, and similar events may cause delay or substitution.
8.2 Reasonable response.
We and the Provider will use reasonable efforts to communicate and arrange an alternative when practicable. This section does not excuse payment or refund obligations already required by these Terms or applicable law.
9. Complaints and Charge Disputes
9.1 Contact us first.
Please report a trip, safety, refund, or charge issue promptly through the Platform or at Support@LimoAllOver.com . Include the booking number and supporting information. Emergencies should be reported to 911 or the appropriate emergency service first.
9.2 Chargebacks.
You retain any lawful right to dispute a charge with your payment provider. We ask that you first allow us a reasonable opportunity to investigate and correct an error. Knowingly submitting a false chargeback or false evidence is prohibited.
10. Platform License and Acceptable Use
10.1 Limited license.
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Platform for lawful booking and trip-management purposes.
10.2 Restrictions.
You may not scrape, copy, reverse engineer, disrupt, overload, bypass security, misuse accounts, introduce malicious code, impersonate another person, or use the Platform for fraud or unlawful activity. Limo All Over and its licensors retain all rights in the Platform, branding, software, and content.
11. Disclaimers and Limitation of Liability
11.1 Platform disclaimer.
Except for express commitments in these Terms and rights that cannot lawfully be waived, the Platform is provided on an “as available” basis. We do not guarantee uninterrupted access, a particular Provider, or trip availability.
11.2 Transportation responsibility.
The independent Provider is responsible for operating the vehicle, employing or engaging its driver, maintaining licenses and insurance, and safely providing transportation. Claims arising from the Provider’s transportation conduct should also be directed to the Provider.
11.3 Liability cap.
To the fullest extent permitted by law, Limo All Over’s aggregate liability arising from an affected booking will not exceed the total amount paid through the Platform for that booking. This cap does not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by conduct for which Limo All Over is legally responsible, or any liability that cannot lawfully be limited.
11.4 Consequential losses.
To the fullest extent permitted by law, Limo All Over is not liable for indirect, incidental, special, punitive, or consequential loss, including missed flights, meetings, or opportunities, unless such exclusion is prohibited by law.
12. Suspension and Termination
12.1 By you.
You may stop using the Platform and request account deletion, subject to record-retention obligations and completion of outstanding bookings or disputes.
12.2 By us.
We may restrict or suspend access to protect safety, investigate suspected fraud, respond to legal requirements, address nonpayment, or enforce these Terms. When practicable, we will provide notice and a way to contact us.
13. Governing Law and Disputes
13.1 Informal resolution.
Before filing a lawsuit, each party should send written notice describing the dispute and requested resolution and allow 30 days for a good-faith response. This does not prevent urgent injunctive relief or a timely small-claims filing.
13.2 New Jersey law and courts.
New Jersey law governs these Terms without regard to conflict-of-law rules. Subject to any non-waivable consumer right, proceedings may be brought in the state or federal courts serving Monmouth County, New Jersey, or in a court of competent small-claims jurisdiction. Nothing here deprives a consumer of mandatory protections of the law of the consumer’s residence.
14. General Terms
14.1 Electronic agreement.
Electronic acceptance, confirmations, and notices have the same effect as paper records and signatures to the extent permitted by law.
14.2 Changes.
We may update these Terms prospectively. We will post the updated date and provide additional notice of a material change when required. The version accepted or in effect when a booking is confirmed generally governs that booking.
14.3 Severability; no waiver; assignment.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A delay in enforcement is not a waiver. You may not transfer your account or these Terms without our consent; we may transfer them in connection with a merger, financing, reorganization, or sale, subject to applicable law.
14.4 Entire agreement.
These Terms, the Privacy Policy , Cancellation and Refund Policy , Cookie Policy , booking confirmation, and any disclosed trip-specific terms form the agreement concerning your use of the Platform.
